Liability Clause
Regarding this website or any of its content, GPM Xpress Logicstics Private Limited offers no guarantees or promises. We disclaim all liability to you and any other person for any direct or indirect damages incurred as a result of using this website. To the extent allowed by law, we disclaim all liability that might result from using this website. By using this website, you accept responsibility for any damage or liability resulting from your use of it.
Liability Clause
The Waybill
The waybill provided by GPM Xpress Logicstics is non-negotiable, and the shipper agrees that it has been created by them or by an executive or partner acting on their behalf. The shipper guarantees that it is either the legitimate owner of the goods being transported or the owner’s authorised agent, and that it hereby agrees to the terms and conditions of the waybill on behalf of itself and any other parties with an interest in the shipment.
Shipper’s Obligation
The shipper guarantees that every item in the cargo is the property listed on the waybill and that the shipment has been properly packaged, labelled, and addressed to guarantee safe transit.
Limitation of Liability
Shipper hereby declares and accepts that the released value of each package or product not enclosed in a package covered by the Waybill is Rs.5000/-, unless a higher value is specified in writing on the Waybill.There is no cargo liability or full risk insurance offered by GPM Xpress Logistics.
Liabilities Not Assumed
GPM Xpress Logicstics disclaims all liability for losses, including incidental, consequential, special, and direct damages.When it comes to acts or omissions by the shipper, such as incorrect direct declaration of goods, inadequate or improper packaging, securing, marking, or addressing of the shipment, or acts or omissions by the recipient or any other party with an interest in the shipment, GPM Xpress Logicstics assumes no liability for loss or damage. Despite making every effort to deliver in line with the company’s regular delivery schedules, GPM Xpress Logicstics shall not be held responsible for any delays in the pickup, transportation, or delivery of any shipment, regardless of the reason for the delay. GPM Xpress Logicstics disclaims all liability for any loss, harm, or delay resulting from occurrences beyond its control, such as acts of God, natural disasters, dangers, or the actual or apparent actions or inactions of governmental authorities (such as customs).
Claims
Any claim as previously stated shall be restricted to a maximum of Rs. 5,000. Any claim must be made by the shipper and sent by mail to GPM Xpress Logistics’ official email addresses within 48 hours after the delivery date. After that point, GPM Xpress Logistics is not subject to any claims.Until all transportation costs have been paid, GPM Xpress Logistics is under no duty to handle any claims; additionally, the amount of the claim cannot be subtracted from these costs. GPM Xpress Logicstics will presume the shipment was delivered in good condition if the recipient accepts it and does not note any damage on the delivery record. The contents, original shipping cartons, and packages must be made accessible for examination in order for a claim for damage to be taken into consideration.
Right to Examine/Prohibit Shipments: GPM Xpress Logistics or any other government agency may open and examine any shipment.
